GHOST is not a user-level tracking or surveillance tool.

3. Eligibility

6. Cancellation & Refunds

• Cancellations take effect at the end of the current billing period
• No refunds are provided for partially used billing periods

7. Acceptable Use

You agree not to:

• Attempt to re-identify individual users
• Track sensitive personal data without lawful basis
• Reverse engineer, scrape, or abuse the Service
• Interfere with system security or availability

Violation of these rules may result in immediate account termination.

8. Data & Privacy

You remain the owner of your data.

By using GHOST, you grant us a limited right to process data solely to provide the Service.

Data processing is governed by our Privacy Policy, which is an integral part of these Terms.

9. Intellectual Property

All intellectual property rights related to GHOST, including:

• Content
• Documentation

remain the exclusive property of KLEINMOND VENTURES.

You may not copy, modify, or distribute any part of the Service without prior written consent.

10. Availability & Service Changes

We aim to provide high availability but do not guarantee uninterrupted access.

We reserve the right to:

• Add or remove functionality
• Suspend or discontinue the Service

without prior notice.

11. Limitation of Liability

To the maximum extent permitted by law:

• GHOST is provided "as is"
• We are not liable for indirect, incidental, or consequential damages
• Total liability is limited to the amount paid by you in the last 12 months

12. Indemnification

You agree to indemnify and hold harmless KLEINMOND VENTURES from any claims arising from:

• Your misuse of the Service
• Violation of these Terms
• Violation of applicable laws

13. Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Abuse the Service
• Fail to pay applicable fees

Upon termination, access to the Service will be revoked and data may be deleted according to the Privacy Policy.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany.

Jurisdiction lies with the courts of Germany.
